All competitions hosted on the PRIZELINK LTD platform are promoted by PRIZELINK LTD, located at 2nd Floor College House, 17 King Edwards Road, Ruislip, London, United Kingdom, HA4 7AE, registered under company number 15612512.

PRIZELINK LTD operates prize competitions that are exempt from the regulations of the Gambling Act 2005 in the United Kingdom.

While we may use the term 'raffle' for marketing and SEO purposes on our platform, it's important to note that all competitions require participants to answer a specific Competition Entry Question. This requirement classifies our competitions as 'Prize Competitions' under the law, distinguishing them from traditional raffles.

The Host

Hosting a Competition on PRIZELINK LTD

General Requirements for Hosting:

  • Competitions must be hosted by the organiser (Host) directly on the PRIZELINK LTD platform.
  • Hosts must not be located or reside in any jurisdiction where hosting a competition is prohibited.
  • All Hosts must be at least 18 years of age.
  • Only those with a verified email address and mobile number are eligible to host competitions.
  • By agreeing to host a competition on PRIZELINK LTD, Hosts accept and agree to be bound by our Terms and Conditions.

Competition Details Hosts Must Provide:

  • Title of the competition.
  • A brief summary of the competition.
  • Detailed prize description and information on how the prize will be delivered or collected (unless the prize is a property).
  • Between one to eight images of the prize.
  • Optional: A promotional image or video.
  • Ticket price unless free to enter.
  • Total number of tickets available.
  • Proposed end date and time for the competition.
  • Information about any charitable donations tied to the competition.

Regulations and Restrictions:

  • PRIZELINK LTD reserves the right to cancel any competition at any time without prior notice.
  • Offering cash payments, bank transfers, gift cards, or shares of ticket revenue as an alternative to the stated prize is strictly prohibited.

Service Charges and Fees:

The Host will pay the Service Charges and any Fees (if applicable) of 15% plus applicable transaction costs on Our Platform. The Service Charges and Fees will be deducted from the Total Proceeds.

How to Enter a Competition at PRIZELINK LTD

Competition Duration:

Each competition runs from the Opening Date to the Closing Date.

Entry Options:

Paid Entry:

  • Entrants must answer the Competition Entry Question unique to each competition, testing skill or knowledge.
  • Payment for tickets must be made using credit/debit cards or other approved methods by PRIZELINK LTD.
  • All ticket payments are strictly non-refundable.

Postal Entry:

  • Entrants must be registered users with a verified email and mobile number.
  • Postal Entries are free of charge.
  • Write your full name, email address, and the ANSWER TO ENTRY-QUESTION (A, B, C, or D) along with the name of the host & the title of the entry on a postcard, and send it by 1st or 2nd class post to:

  • Only one entry is permitted per postcard. Additional entries on the same postcard will be discarded.
  • Postal Entries must be received at least 72 hours before the competition's advertised end-date. Entries received within 72 hours of the competition ending will not be included in the draw.

General Entry Conditions:

Entry into the competition does not depend on answering the entry question correctly; however, only tickets with the correct answers or valid Postal Entries will be eligible for the final draw as per Gambling Commission regulations.

By entering the competition, via ticket purchase or Postal Entry, participants agree to be bound by these Terms and Conditions.

Additional Postal Entry Requirements:

  • Entrants must ensure that all required details on the Postal Entry are legible and correctly addressed to PRIZELINK LTD as specified.
  • PRIZELINK LTD reserves the right to reject any Postal Entries that do not meet the specified conditions.
  • PRIZELINK LTD is not liable for postal delays, lost, or damaged entries, or any issues classified as Force Majeure.

Eligibility Criteria for Competitions at PRIZELINK LTD

General Entry Requirements:

  • Entrants must not be physically located in a jurisdiction where participating in such competitions is prohibited at the time of their entry.
  • All Entrants must be at least 18 years of age.

Restrictions on Participation:

  • Employees or shareholders of PRIZELINK LTD or its holding or subsidiary companies are not eligible to enter.
  • Employees of agents or suppliers of PRIZELINK LTD who are professionally connected with the administration of the competition are also excluded.
  • Immediate family members or household members of the above-mentioned employees, shareholders, agents, or suppliers are prohibited from entering.
  • Competitions hosted by PRIZELINK LTD cannot be entered by family members or household members of the Host.

Entry Integrity and Compliance:

Entrants must affirm their eligibility to participate and claim any prizes they may win. PRIZELINK LTD reserves the right to request proof of eligibility.

Entries must not be:

  • Automatically generated by computer software.
  • Completed by third parties, in bulk, or through syndicated entry services.
  • Altered, reconstructed, forged, or otherwise tampered with.
  • Entries on behalf of another person or joint submissions are not permitted.

PRIZELINK LTD retains the right to disqualify any Host, Entrant, or Winner whose conduct does not align with the spirit or intentions of the competition.

Platform-Specific Eligibility:

Only registered users of the PRIZELINK LTD platform are eligible to enter competitions.

The Prize

Prize Details:

The specifics of the prize for each competition are detailed in the competition particulars.

Prize Transfer:

The Host is obligated to transfer the prize to the Winner following the guidelines provided in Section 9 of these Terms and Conditions.

Prize Conditions:

Prizes awarded in PRIZELINK LTD competitions are non-negotiable and non-transferable.

Claiming the Prize:

Winners must adhere to the claiming procedures outlined in the Terms and Conditions to successfully claim their prize.

Winners

Selection of Winners:

Only tickets that correctly answer the Competition Entry Question will qualify for entry into the draw for each competition. Winners are selected randomly by PRIZELINK LTD’s automated system on the competition's Closing Date. The decision is final, and no correspondence or discussions will be entered into.

Notification and Publication:

PRIZELINK LTD will publish the name of the Prize Winner, as provided in the winner's profile, on the Draw Date to confirm that a valid award has occurred, adhering to the Privacy Policy available on our platform.

On the Draw Date, PRIZELINK LTD will email all entrants using the email addresses registered with their accounts to notify them of the draw results. Winners are not contacted individually; it is each entrant’s responsibility to check the platform to see if they have won.

Communication with Winners:

If a winner has provided a telephone number, PRIZELINK LTD or the Host may choose to contact the winner directly to inform them of their win.

On the Draw Date, the Host will receive an automated email with instructions on how to proceed. This email will include the winner's contact details, such as name, email address, and mobile telephone number, consistent with our privacy practices.

Claiming the Prize

Notification and Winner Responsibility:

Winners will not be contacted individually. Each entrant must proactively check PRIZELINK LTD's platform to determine if they have won.

Arranging Prize Delivery or Collection:

  • It is the responsibility of both the Host and the Winner to communicate directly to arrange for the delivery or collection of the prize.
  • This action must be taken within 21 days from the Draw Date.

Restrictions on Prize Claiming:

Prizes cannot be claimed by anyone other than the Winner; third-party claims on behalf of the Winner are not permitted.

PRIZELINK LTD is not responsible if the Winner is unable to accept or take up the prize for any reason.

Delivery/Collection of Prizes

General Arrangements:

The delivery of the prize is not automatically included and will only be provided if specified in the competition particulars. Consequently, the Host and the Winner are responsible for arranging the delivery or collection of the prize directly between themselves.

Arranging Collection:

If the prize is to be collected, the Host and Winner must directly communicate to set a mutually agreeable date and time for collection.

Responsibilities for Safe Exchange:

The Host must take all necessary precautions to ensure a safe and secure exchange of the prize. This includes obtaining all relevant shipment, collection, or delivery receipts, which may be required as proof in the event of a dispute.

Protocol for Prize Exchange:

If a physical meeting between the Host and Winner is necessary for the prize exchange, it is the responsibility of both parties to ensure that the prize acceptance is confirmed on PRIZELINK LTD's platform at the time of the exchange. The winner will be notified by email when the host has confirmed delivery of the prize, and the winner must then confirm delivery. If we do not hear from the winner within 7 days the prize will automatically be confirmed.

Acceptance and Disputes

Finality of Decisions:

All participants agree that PRIZELINK LTD's decisions regarding the conduct of competitions are final and binding.

Prize Acceptance and Dispute Window:

Winners have 21 days from the Draw Date to either accept or dispute the Prize on our platform.

Acceptance of the Prize:

By accepting the Prize on PRIZELINK LTD's platform, the Winner confirms that the Prize matches the description in the competition particulars and that they have taken possession of the Prize.

Upon accepting the Prize, the Winner waives any right to dispute the Prize or claim further compensation, agreeing to the release of the Host’s Proceeds to the Host or their designated charity or cause.

Disputing the Prize:

If the Winner disputes the Prize on our platform, alleging that it does not match the advertised description or they have not received it, the case will be investigated by our Disputes Team.

The investigation may lead to:

  • If the dispute favours the Host, the Host's Proceeds will be released as planned, and the Winner will forfeit any claims under these Terms and Conditions.
  • If the dispute favours the Winner, PRIZELINK LTD is not obligated to pay the Host's Proceeds to the Host or charity. The Winner may receive compensation amounting to 50% of the Total Proceeds.

Multiple Prizes and Disputes: If multiple prizes are involved and one is disputed, the compensation will be divided equally among the disputed prizes, with each disputing Winner receiving 50% of their allocated share of the Total Proceeds.

Failure to Act:

If the Winner neither accepts nor disputes the Prize within 21 days, they lose the ability to do either, and the Host's Proceeds will automatically be released to the Host or their charity, at which point the Winner forfeits all rights under these Terms and Conditions.

Legality and Binding Nature of Decisions:

Decisions made by PRIZELINK LTD regarding any dispute are final and legally binding, with no right to appeal or engage in further correspondence.

Limitation of Liability

To the extent allowed by law, PRIZELINK LTD, along with its agents or distributors, does not have a duty of care towards the Winner, the Host, or any Entrant, and will not be liable for any compensation nor accept liability for any loss, damage, personal injury, or death that may occur from accepting or using the prize, except in cases of negligence by PRIZELINK LTD, its agents, or its employees. Your statutory rights remain unaffected.

Ownership of Competition Entries and Intellectual Property Rights

Ownership and Use of Content:

PRIZELINK LTD does not claim any ownership rights in the content of your competition entries.

The Host acknowledges that PRIZELINK LTD may, but is not obligated to, display the Host's competition on our Platform and other media, current or future, for any promotional activities related to the competition.

The Host grants PRIZELINK LTD a non-exclusive, worldwide, irrevocable licence to use, display, publish, transmit, copy, edit, alter, store, re-format, and sublicense the competition entries and any related materials throughout the duration of the intellectual property rights in the competition.

Management of Content and Accounts:

PRIZELINK LTD reserves the right to terminate or force the forfeiture of any username or web address at our discretion, particularly if they infringe on third-party intellectual property rights, potentially mislead others, or become inactive.

PRIZELINK LTD retains the authority to remove any content from our Platform for any reason, including but not limited to, content that has been flagged, is deemed offensive or violates the legal rights of any third party.

User Responsibilities:

All participants, including Hosts, Entrants, and Winners, are responsible for ensuring that their usernames and the content they post do not violate any third party's rights, including intellectual property rights like trademarks.

By using PRIZELINK LTD’s services, participants represent and warrant that:

  • They are not located in, nor are residents of, any jurisdiction where hosting or participating in the competitions is prohibited.
  • The content they share does not violate any privacy rights, copyrights, contractual rights, or any other rights.
  • The content they share does not breach any contract with a third party.
  • As Hosts, they have legal ownership of, and the right to offer, the items used as prizes in the competitions, and can grant the licences required by these terms.

Technical Operations:

Participants agree that PRIZELINK LTD may perform necessary technical functions such as transcoding and formatting content to facilitate its use on our Platform.

User Profiles

Profile Responsibility:

Users are solely responsible for maintaining their profiles on PRIZELINK LTD's platform.

Each user must ensure that their profile complies with all applicable laws and does not infringe on any third-party rights, including intellectual property rights like trademarks.

Indemnification:

Users agree to indemnify and hold PRIZELINK LTD harmless against any claims of infringement or violation of laws resulting from the content or information they provide in their profiles.

Profile Updates:

Users have the ability to update their contact information in their profiles.

Following and Notifications:

Users will automatically be following hosts for events they enter. By entering, you agree to receive email updates about the competitions hosted by those hosts, which may include information on ongoing competitions, winners, and other pertinent news.

Users can opt-out of receiving these notifications at any time by adjusting their user preferences in their profiles and unfollowing other users.

Data Protection and Publicity

PRIZELINK LTD will process your personal information strictly in accordance with the Privacy Policy available on our platform.

Unacceptable Behaviour

General Policy:

All participants, including Hosts, Entrants, and Winners, are required to conduct themselves appropriately and avoid any behavior that could diminish the experience of others during any competition hosted by PRIZELINK LTD.

Examples of Unacceptable Behaviour:

  • Disrupting the enjoyment of other participants through negative or harmful actions.
  • Using threatening, abusive, or insulting language or behaviour towards other participants or PRIZELINK LTD staff.
  • Engaging in actions that could cause damage, nuisance, or injury to PRIZELINK LTD, its participants, or their property.
  • Cyberbullying, harassment, or any form of intimidation or threatening behaviour.

Consequences of Unacceptable Behaviour:

Any participant found engaging in unacceptable behaviour may, at PRIZELINK LTD’s sole discretion, forfeit any rights or privileges accrued under the Terms and Conditions or any competitions they are participating in.

PRIZELINK LTD reserves the right to remove any offending content and/or ban any user from the platform without prior explanation.

Decisions made by PRIZELINK LTD regarding unacceptable behaviour are final and legally binding, and no correspondence or discussion will be entertained.

Prohibited Items

Items listed on the Prohibited Items page of our platform are not permitted to be offered as prizes in any competition hosted by PRIZELINK LTD.

Guarantee

Compensation for Non-Delivery of Prizes: Should a Host fail to deliver a promised prize, Winners will receive compensation amounting to 50% of the Total Proceeds from the relevant competition.

Multiple Winners and Prizes: In cases where a competition involves multiple Winners and multiple Prizes, and the Host fails to provide any or all of the Prizes, each Winner will receive an equal share of the compensation. The combined compensation for all Winners will total 50% of the competition’s entire ticket sales.

General Terms

Breach of Terms:

Should there be reasonable grounds to suspect that there has been a violation of these Terms and Conditions, PRIZELINK LTD reserves the right, at its sole discretion, to prohibit you from participating in current or future competitions. Additionally, PRIZELINK LTD may ban you from using our platform.

Competition Management:

PRIZELINK LTD reserves the right to void, suspend, cancel, or amend any competition as necessary.

Service Level and Interruptions

Platform Availability:

You acknowledge that there may occasionally be interruptions to our service on the PRIZELINK LTD platform due to scheduled maintenance, upgrades, emergency repairs, or failures in telecommunication services and equipment that are beyond our control.

Efforts to Maintain Service:

PRIZELINK LTD will make reasonable efforts to ensure the platform remains accessible and usable according to these Terms and Conditions. However, it is recognized that continuous, uninterrupted service without errors cannot be guaranteed.

Force Majeure

Exemption from Liability:

PRIZELINK LTD, any Host, or Partner shall not be considered in breach of these Terms and Conditions, nor liable for any delay in performing, or failure to perform, any of their obligations under these terms if such delay or failure results from a Force Majeure Event.

Adjustments During Force Majeure:

In the event of a Force Majeure Event, competition Hosts and Partners may receive a reasonable extension of time to fulfil their obligations, as determined by PRIZELINK LTD based on reasonable discretion. If the period of delay or non-performance continues for four weeks, PRIZELINK LTD may:

  • Terminate the competition, providing two days' written notice to the Host, or
  • If the competition has ended and the prize has not yet been dispatched to the winning Entrant by the Host or Partner, allocate the income from the competition to the rightful winning Entrant, as per the Compensation for Non-Delivery of Prizes clause in these Terms and Conditions.

Publicity and Advertising

Participation in Publicity:

Should PRIZELINK LTD request, both Hosts and Winners are expected to participate in publicity activities related to the competition. This may include, but is not limited to, engaging in interviews, promotional recordings for social media, press outlets, and television programs, and making publicity-related posts on their personal social media platforms as directed by PRIZELINK LTD. These activities may occur during and after the competition has concluded.

Use of Personal Attributes:

Each Host and Winner consents to PRIZELINK LTD using their name, image, or likeness for advertising, publicity, or other business purposes for a period of five years following the Competition End Date. The use of the Host's or Winner's personal attributes will be considered neither an invasion of privacy nor a violation of any property rights, and no additional compensation will be provided for such use.

Ownership of Promotional Materials:

Hosts and Winners agree that any materials created in connection with their participation in publicity activities, including negatives, prints, or other materials necessary for printing or reproduction, will be the exclusive property of PRIZELINK LTD. These materials can be used by the Host with written authorisation from PRIZELINK LTD.

No Promotion

The competitions hosted on our platform are not sponsored, endorsed, administered by, or associated with Apple Inc., Google, Facebook, Twitter, Snapchat, TikTok, or any other social network that you find PRIZELINK LTD or the Host publishing on.

Entire Agreement

These Terms and Conditions represent the complete and exclusive agreement between PRIZELINK LTD and you, superseding all prior agreements, promises, representations, and understandings related to the subjects covered by these terms, whether they were written or oral.

Waiver

No failure or delay by PRIZELINK LTD in exercising any right or remedy provided under these terms or by law will act as a waiver of those or any other rights or remedies, nor will it prevent or restrict any further exercise of those or any other rights or remedies. No single or partial exercise of a right or remedy will prevent or restrict the further exercise of that or any other right or remedy.

Severance

Should any provision or part of a provision in these Terms and Conditions be or become invalid, illegal, or unenforceable, it will be considered deleted. This deletion will not affect the validity and enforceability of the remaining provisions of the Terms and Conditions.

Third Party Rights

These Terms and Conditions do not create any rights that are enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999.

Governing Law

These Terms and Conditions, along with any disputes or claims (including non-contractual disputes or claims) that arise out of or in connection with them, their subject matter, or their formation, are governed by and construed in accordance with the laws of England.

Jurisdiction

Each party irrevocably agrees that the courts of England will have exclusive jurisdiction to resolve any disputes or claims (including non-contractual disputes or claims) that arise out of or relate to these Terms and Conditions or their subject matter.
